1. Acceptance of Terms
By purchasing Crestview data, customer accepts these terms. If you do not agree, do not purchase. Contact sales@crestviewanalytics.com if you have concerns.
2. Grant of License
Crestview grants a non-exclusive, non-transferable license to use the Professional Plan database for 12 months from purchase date.
License is limited to Customer and Customer's employees acting on Customer's behalf. No sublicensing, resale, or redistribution permitted.
3. Permitted Uses
ONLY for:
- Lead identification and business development
- Real estate investment analysis
- Wealth management and financial planning
- Commercial lending and underwriting
- Market research and trend analysis
- Internal business planning
4. Prohibited Uses & Data Restrictions
NOT permitted:
- Resale or sublicensing
- Public disclosure or publication
- Competitive intelligence for non-customers
- AI/ML model training or compilation
- Sale in connection with business sale or merger (without consent)
- Unauthorized sharing (see separate NDA requirement)
- Merging with other datasets for resale
- Storage beyond 12 months from purchase
- Use for unsolicited spam or CASL violations
- Use for harassment, fraud, or illegal purposes
Violation may result in immediate termination.
5. Data Accuracy & Warranties
Crestview warrants data accuracy as of January 2025 based on publicly available records. Data reflects professional licensing status, property ownership, and income information as of January 2025.
Crestview does NOT warrant that:
- Professionals still own listed properties
- Professionals maintain current licenses indefinitely
- Data will never become outdated
- All business activities will succeed using this data
Data is provided AS-IS with limited warranty.
6. Data Accuracy Remedies
If Customer identifies inaccurate data affecting >15% of purchased records within 30 days, Crestview will offer:
- Partial refund (25β50% of purchase price), OR
- Updated dataset at no charge, OR
- Credit toward future purchases
Customer must submit inaccuracy report with specific details (names, license #s, property addresses, nature of inaccuracy). Crestview will investigate and respond within 14 days. This is Customer's sole remedy for data inaccuracy.
7. Payment & Pricing
- Professional Plan pricing available upon request
- Payment due upon order
- Accepted payment methods: Credit card, ACH, wire transfer
- Refunds: Only if accuracy threshold exceeded (see Section 6)
- No refunds for changed business needs or buyer's remorse
8. Non-Disclosure & Data Confidentiality
This license includes a mandatory Non-Disclosure Agreement (NDA). Customer must sign NDA before data access is granted.
Key restrictions:
- No resale or sublicensing
- No unauthorized sharing with third parties
- No public disclosure or media distribution
- Strict confidentiality obligations
- Breach may result in immediate termination + damages claim

9. CASL & Legal Compliance
Customer assumes full responsibility for CASL compliance.
Customer must:
- Obtain express written consent before sending commercial emails, texts, or phone calls to leads
- Include unsubscribe options in all messages
- Honor opt-out requests within 10 business days
- Comply with Do Not Call List and other regulations

10. Customer Responsibilities & Indemnification
Customer warrants:
- They are authorized to enter into this agreement
- They are a legitimate business operating in real estate, wealth management, or commercial lending
- They will use data only for lawful purposes
- They will maintain data security
- They will comply with all applicable laws
Customer indemnifies Crestview against claims arising from Customer's breach of these terms, unauthorized disclosure, or violation of law.
11. Limitation of Liability
CRESTVIEW'S LIABILITY IS LIMITED TO THE AMOUNT PAID FOR THE LICENSE
CRESTVIEW IS NOT LIABLE FOR:
- Business outcomes or failed deals
- Lost profits or revenue
- Indirect, incidental, or consequential damages
- Data breaches caused by Customer's negligence
- Third-party claims (except as indemnified)
CUSTOMER ASSUMES ALL RISK for business decisions based on data. Some jurisdictions do not allow liability limits; where not allowed, liability is limited to the maximum extent permitted by law.
12. Term & Termination
- License Term: 12 months from purchase date
- Auto-renewal: No (must repurchase)
- Termination by Customer: 30 days written notice
- Termination by Crestview: Immediate, if Customer breaches agreement, payment not received, Customer acquired by competitor, or material security concern arises
Upon termination, all license rights cease immediately; Customer must delete all data within 30 days and certify deletion in writing.
13. Data Security & Breach Notification
Crestview implements industry-standard security controls. In event of unauthorized access or breach:
- Crestview will investigate within 24 hours
- Crestview will notify Customer within 24 hours of confirmation
- Crestview will notify BC Privacy Commissioner if required by law
- Crestview will provide guidance on remedial steps
This is NOT a warranty; Crestview is not liable for breaches caused by Customer negligence or third-party attacks beyond Crestview's reasonable control.
14. Intellectual Property
All data, methodologies, analyses, and Crestview intellectual property remain the sole property of Crestview. Customer acquires no ownership rights, copy rights, trademark rights, or trade secret rights.
15. RESA & Real Estate Compliance
Customer acknowledges they are a real estate professional and must comply with BC's Real Estate Services Act (RESA) and the Council of Real Estate Associations Code of Conduct. Crestview data must be used ethically and in accordance with professional standards.
16. Dispute Resolution & Governing Law
- Governing Law: Province of British Columbia
- Venue: BC Supreme Court (Customer waives objection to jurisdiction)
- Mediation: Parties agree to attempt mediation before litigation (48-hour notice)
- Costs: Prevailing party may recover reasonable legal costs

Crestview reserves the right to update these terms with 30 days' notice. Continued use after update = acceptance of new terms.
